FOIL (Freedom of Information Law) is New York State's public records law. Any person can request access to existing records from state and local government agencies. You don't need to be a New York resident, provide a reason for the request, or identify yourself (though agencies may request contact information).

Agencies must respond within 5 business days, either providing the records, denying the request, or acknowledging receipt and providing a reasonable date when records will be provided (typically not exceeding 20 business days from receipt of request).

Agencies may charge for photocopying (up to 25 cents per page) but cannot charge for staff time to locate or review records. Agencies must provide an estimate if costs exceed $50 and can require prepayment.

If denied, you can appeal to the agency head within 30 days. If the denial is upheld or the agency fails to respond, you can petition for Article 78 review in State Supreme Court. You can also file a complaint with the Committee on Open Government.

Yes. Exemptions include records that would invade personal privacy, endanger life or safety, are protected by attorney-client privilege, or are part of ongoing law enforcement investigations. However, agencies must still provide any non-exempt portions of records.
